Your California Privacy Rights

This section of the Privacy Policy provides additional information solely for California residents, as required under the California Consumer Privacy Act of 2018 (“CCPA”) and applies to their “personal information” as defined in the CCPA, whether collected online or offline. This section of the Privacy Policy prevails over any conflicting provisions of this Privacy Policy with regard to Californians’ personal information.

“Personal information” means information that identifies, relates to, describes, references, is reasonably capable of being associated with, or could reasonably be linked, directly or indirectly, with a particular consumer or device (“personal information”). This and any other terms defined in the CCPA have the same meaning when used in this section.

Note, however, that there are a number of exemptions from the application of the CCPA. The table below sets out some of the categories of personal information (as defined by the CCPA) that are not subject to the CCPA, and therefore are not covered by this California section of the Privacy Policy. Note that other sections of the Privacy Policy may still apply in addition to other privacy notices that we may issue addressing our specific relationship with you, including privacy notices that are sent to individuals.

Categories of Personal Information Exempt Under CCPA

  • Personal information we collect about job applicants, independent contractors, or current or former full-time, part-time and temporary employees and staff, officers, directors or owners of Desert Champions, and that is used solely in that context.

  • Publicly available information from government records.

  • Except for your Right to Opt-out and your Right of Non-Discrimination (see “Your CCPA Rights and Choices” below), personal information we collect in a “business-to-business context”. This personal information is collected when we engage in business-to-business transaction or communicate solely in the context of conducting due diligence for, providing or receiving a product or service to or from a company and obtain personal information regarding California residents.

Information We Collect and Disclose

We have collected (or not collected, if indicated below), the following categories of personal information below from California residents within the last twelve (12) months. The chart also lists the categories of personal information we disclose for a business purpose. Our collection, use and disclosure of personal information about a California resident will vary depending upon the circumstances and nature of our interactions with you.

Name, Contact Information and other Identifiers: Identifiers such as a real name, email address, and address.[alias, unique personal identifier, online identifier, Internet Protocol (IP) address, account name, driver’s license number, passport number, or other similar identifiers]

Geolocation Data: Precise geographic location information about a particular individual or device.

We obtain the categories of personal information listed above from the following categories of sources:

  • Directly from you, including when you register or subscribe for accounts or features on this Website, make online purchases, complete surveys, or participate in our tournaments; and

  • Through the Websites, including through cookies, our servers, and other automated technologies.

When You Attend and Participate in Our Tournaments

When you attend or participate in a Desert Champions tournament, you may be in an area where photography, filming, or recording may occur. Photography, filming, or recording may be conducted by third parties. Desert Champions is not responsible for any photography, filming, or recording conducted by any third party.

Use of Personal Information

We may use and/or disclose the personal information we collect for one or more of the following business purposes:

Providing Support and Services. Including to register you as a new customer; to process and deliver your tickets; to process and manage payments, fees, and charges; and to collect and recover money owed.

  • Analyzing and Improving Services and Operations. Including to manage our relationship with you; to notify you about changes to our terms or privacy policy; and to conduct surveys or other evaluations.

  • Advertising, Marketing and Promotional Purposes. Including to use data analytics to understand the effectiveness of and improve our website, advertising, services, marketing, customer relationships and experiences;

  • Securing and Protecting Our Business. Including to administer and protect our business and this website (including securing and protecting our business, troubleshooting, data analysis, testing, system maintenance, support, reporting and hosting of data).

  • Personalizing Content and Experiences. Including to make suggestions and recommendations to you about goods or services that may be of interest to you.

  • Complying with Legal Obligations. Including to comply with the law, our legal obligations and legal process, such warrants, subpoenas, court orders, and regulatory or law enforcement requests.

Disclosures of Personal Information

We disclose your personal information for a business purpose to the following categories of third parties: entities owned in whole or in part by Desert Champions and service providers.

Sale of Personal Information

We do not sell your personal information, but we may share your personal information in the event Desert Champions, or substantially all of its assets, is acquired by one or more third parties as a result of an acquisition, merger, sale, reorganization, consolidation, or liquidation as part of the evaluation or completion of such transaction.

Your Rights and Choices

The CCPA provides California residents with specific rights regarding their personal information. This section describes your CCPA rights and explains how to exercise those rights, at no-charge.

Requests to Know

California residents have the right to request and, subject to certain exemptions, receive a copy of the specific pieces of personal information that we have collected about you in the prior 12 months and to have this information delivered to you, free of charge, either (a) by mail or (b) electronically in a portable and, to the extent technically feasible, readily useable format that allows the individual to transmit this information to another entity without hindrance.

California residents also have the right to request that we provide them certain information about how we have handled their personal information in the prior 12 months, including the:

  • categories of personal information collected;

  • categories of sources of personal information;

  • business and/or commercial purposes for collecting and selling their personal information;

  • categories of third parties/with whom we have disclosed or shared their personal information;

  • categories of personal information that we have disclosed or shared with a third party for a business purpose;

  • categories of personal information collected; and

  • categories of third parties to whom the residents’ personal information has been sold and the specific categories of personal information sold to each category of third party.

California residents may make Requests to Know up to twice every 12 months.

Requests to Delete

You have the right to request that we delete any of your personal information that we collected from you, unless an exception applies. We may deny your deletion request if retaining the information is necessary for us or our service provider(s) to:

  • Complete the transaction for which we collected the personal information, provide a good or service that you requested, take actions reasonably anticipated within the context of our ongoing business relationship with you, or otherwise perform our contract with you;

  • Detect security incidents, protect against malicious, deceptive, fraudulent, or illegal activity, or prosecute those responsible for such activities;

  • Debug products to identify and repair errors that impair existing intended functionality;

  • Exercise free speech, ensure the right of another consumer to exercise their free speech rights, or exercise another right provided for by law;

  • Comply with the California Electronic Communications Privacy Act (Cal. Penal Code § 1546 et. seq.);

  • Engage in public or peer-reviewed scientific, historical, or statistical research in the public interest that adheres to all other applicable ethics and privacy laws, when the information’s deletion may likely render impossible or seriously impair the research’s achievement, if you previously provided informed consent;

  • Enable solely internal uses that are reasonably aligned with consumer expectations based on your relationship with us;

  • Comply with a legal obligation; or

  • Make other internal and lawful uses of that information that are compatible with the context in which you provided it.

Do Not Sell My Personal Information

While you also have the right to opt-out of sale of your personal information if a company sells their personal information, Desert Champions does not sell personal information as we understand that term to be defined by the CCPA and its implementing regulations. We do not sell personal information about California residents whom we know are younger than 16 years old.

Exercising Access and Deletion Rights

To exercise the access and deletion rights described above, please submit a request to us by either calling us at (855) 468-5490, or by filling out our CCPA Consumer Rights Request Form.

Non-Discrimination

We do not discriminate against you for exercising your rights or offer you financial incentives related to the use of your personal information.

Shine the Light

Pursuant to Section 1798.83 of the California Civil Code, our customers who are California residents have the right to request certain information regarding the disclosure of their personal information to third parties for such third parties’ direct marketing purposes. To make such a request, please contact us in the manner prescribed in the following section titled “Contact Us.”
